Terms of Service
Effective and last updated October 5, 2026
1. Accepting these terms
By using the Austin Rowing Club crew management app (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. Nonprofit licensee
The Service is licensed to and operated by Austin Rowing Club ("ARC"), a Texas 501(c)(3) nonprofit organization. It is an internal tool for ARC members, athletes, coaches, and staff to organize practices, race preparation, and club communication.
3. Eligibility and your account
- Access is limited to ARC members, guest rowers, and coaches approved by ARC.
- You are responsible for keeping your login safe and for all activity on your account.
- Keep your contact details and rowing abilities accurate. Coaches rely on them for safety on the water.
4. Coach-made lineups; no artificial intelligence
All boat assignments, seats, coxswain assignments, and practice schedules are set by hand by ARC coaches and staff. This software does not use artificial intelligence, automated algorithms, or automated decision-making. ARC has full discretion over all lineups and roster decisions.
5. Attendance and no-shows
Every seat in a boat affects the whole crew. You agree to follow club sign-up cutoffs (normally noon the day before practice) and attendance policies. Coaches may record a no-show if you miss a practice you signed up for without withdrawing before the cutoff.
6. Security and limitation of liability for unauthorized access
ARC and its technology providers take security seriously and make every reasonable effort to protect the Service from unauthorized access, data loss, and cyber threats.
To the fullest extent permitted by law, the Service is provided "as is" and "as available." ARC, its officers, directors, coaches, volunteers, agents, and licensors do not guarantee that the Service is secure against every form of attack or intrusion. Neither ARC nor its software licensors shall be liable for any direct, indirect, incidental, consequential, or special damages arising from any unauthorized access to, alteration of, breach of, or theft of data, except where caused by gross negligence or willful misconduct.
7. Water safety and weather
Weather radar, National Weather Service alerts, lightning, and wind maps in the app come from third parties and are for information only. They do not replace coach judgment, USRowing safety guidance, or ARC safety rules. The decision to launch or clear the water rests with ARC coaches.
8. Changes
ARC may update these Terms to reflect changes in club policy, safety rules, or features. Continuing to use the Service after an update means you accept the new Terms.
9. Governing law
These Terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts in Travis County, Texas.
